Terms & Conditions

 

Our Terms & Conditions describe our policies and procedures and clarify the contractual relationship between you, the client, and Fountain Retreats Limited. Please ask us if you have any questions.

Your use of our website is subject to our Privacy Policy which sets out the terms on which we process any personal data provided to us by you in the course of your making a booking through our online Booking System, or that which may from time to time be provided to us by you through any other method of communication.

GENERAL

Our retreats are designed for women who may be Peri-menopausal, Menopausal or Post-Menopausal, or women over the age of 21 years who are interested in women’s midlife health.

DEPOSIT

If a booking is made 4 weeks or more before the first day of the Retreat, you may choose to either pay in full, or pay a deposit of 10%.

If a booking is made less than 4 weeks before the first day of the Retreat, the fee must be paid in full.

FINAL PAYMENT

Please note that all payments are to be paid in full 4 weeks prior to the start of the Retreat, with the exception of any late bookings which are accepted by the company and which need to be paid in full on acceptance.

We regret that no refunds may be issued for cancellations made within 4 weeks of the first day of the Retreat as we have to commit to paying for the venue and the expert speakers in a similar timeframe.

If the balance of Retreat fee is not paid by you on the due date, then you will be deemed to have cancelled your booking and Fountain Retreats Limited will retain the Deposit you have paid.

VAT

Retreat prices shown on the Website will be inclusive of VAT at the current rate.

METHOD OF PAYMENT

All payments are to be made by credit or debit card through our booking site.

CANCELLATIONS

Any booking cancellations or postponements must be given in writing.

A full refund is given for cancellations or postponements made more than 4 weeks prior to the commencement of your Retreat booking.

No refunds are given if you cancel within 4 weeks of the start of the Retreat. If you cannot attend due to illness or other reason, you can transfer your place to another guest. We will require details of the replacement guest as soon as possible.

All of the above applies even for late arrival, early departure, flight cancellations, travel delays, injury, illness, bereavement or death. For these reasons, we recommend that you take out your own cancellation insurance in relation to your booking.

If you fail to arrive on the first day of the Retreat, or any subsequent days, a refund will not be given under any circumstances.

We reserve the right to cancel or postpone the Retreat at any time. However, we will always endeavour to fulfil our commitment you. In the event of a cancellation on our part, we will offer either a full refund or a replacement date or a credit note.

We cannot, however, compensate you for airfare or travel costs incurred. To cover these risks, we recommend you purchase travel insurance.

BOOKING CONFIRMATION

All booking confirmations and documents will be sent to you via email. It is your responsibility to ensure that the email address given is correct. Please check your spam box regularly.

CHANGES TO THE RETREAT

We reserve the right to change the itinerary of the Retreats programme at any time and/or the location of venue at any time. A change of venue would only ever be done in emergency situations or if the property was deemed to be unfit for purpose.

PRICE CHANGES

Fountain Retreats Limited reserves the right to amend prices on the Website due to errors or omissions, but we will notify you of such changes as soon as possible. You will then have the right to cancel your booking if the amended price is higher than the original price quoted.

YOUR RESPONSIBILITIES AS OUR GUEST

As Yoga is offered at our Retreats, and you may also wish to take walks or use other exercise facilities at the Retreat venues, you must inform us, prior to commencement, of any knowledge you may have that your health might be at risk by taking part. Management have to right to refuse to allow you to take part in activities if they believe is this going to cause detriment to your health or other clients’ health.

Please be aware that if you have an infectious or contagious disease/condition, we have the right to turn you away without a refund. We cannot put any clients at risk and thus you should not attend if you are unwell. We regret that we cannot refund any monies should you be refused entry or If you choose not to take out insurance to cover this eventuality, then you will not be.

You should also inform us, at the time of booking and prior to your arrival, of any allergies, food intolerances, asthma or any other condition that you feel would affect our ability to provide you with a balanced nutritious diet including beverages.

Excessive consumption of alcohol and/or drug abuse is not acceptable at our Retreat venues and we reserve the right to refuse access to the Retreat should this come to light. Bringing any alcohol and drugs to the Retreat is not permitted and NO SMOKING is allowed inside any of the Retreat venues.

Any damages of Fountain Retreats property incurred by you at the Retreat premises must be paid for directly to the host/licensee of the venue. Any damages you may incur to the buildings, hard or soft furnishings, or any other asset or item(s) owned by the venue in any property or in the gardens or overall grounds and curtilage of the venue, must be accounted for by you to the venue management or venue administrators on-site, whichever is applicable. We do advise that you take out personal insurances to cover any such eventuality.

You are responsible as the client to come with all the relevant practical clothing and footwear for the activities offered during your stay. You are also responsible for your own health and medical requirements. Details of what to bring will sent by email prior to the start of the Retreat.

You, as our client, must recognise that any activity may have a risk of personal injury and, again, we advise you to think about taking out extra personal insurance to cover this eventuality.

LIABILITY

Fountain Retreats Limited does NOT accept any liability for:

  • Cancellations, delays or changes caused by war, threat of war, terrorist actions or threats, closure of airports, civil strike, industrial action, natural disaster, technical problems to transport, staff cancellations, weather or other events beyond our control.
  • Loss of, or damage to, personal property of participants.
  • Personal injury or harm due to non-disclosure of information. If you have had any major physical or emotional illness within the past 5 years, or are under medical or psychiatric supervision, you must notify us of the details at the time of booking. For severe food allergies, please ensure that you complete the relevant information on our booking form. We do our best to cater for all dietary requirements, but we cannot guarantee the absence of cross-contamination in the kitchen. In the case of severe allergies, a separate disclaimer will have to be signed.
  • Personal injury or harm arising from any action taken by you as a result of information you receive during the Retreat from our experts, hosts or other Retreat participants. We encourage you to seek qualified professional advice before embarking on any course of self-treatment.

Nothing in these clauses excludes or limits the liability of Fountain Retreats Limited for any matter which it would be illegal for Fountain Retreats to exclude or attempt to exclude in terms of their liability.

COMPLAINTS

All complaints must be made in writing to Fountain Retreats Limited as soon as reasonably practicable.

You, as the client, agree that Fountain Retreats shall be given the opportunity of investigating and addressing the complaint within a reasonable time.

SEVERABILITY

In the event that a court finds that a condition (or part of a conditions) in these Conditions is invalid, unenforceable or illegal, the other conditions shall remain in force.

GOVERNING LAW AND JURISDICTION

The contract between you, the client, and Fountain Retreats Limited shall be governed by the laws of the United Kingdom. Each party irrevocably agrees that the courts of the United Kingdom shall have the exclusive jurisdiction to settle any dispute of claim arising out of or in connection with the contract or its subject matter or formation (including non-contractual disputes or claims).
